Estate Planning Lawyer in Van Nuys

Many families assume probate only applies to complicated estates. California does not measure it that way. The state uses dollar limits to decide whether an estate can use a simpler process, and one house bought decades ago can push an estate past those limits. An estate planning lawyer in Van Nuys can show you where your family stands and what it would take to keep your property out of court.

Consider one example household built a piece at a time. It starts with a savings account and a long held home, then adds a will, a trust, retirement accounts and a transfer on death deed. Each added piece changes the answer.

Gold Law has worked with families in Ventura and Los Angeles Counties since 1998, from its office at 484 Mobil Avenue, Suite 26 in Camarillo. Van Nuys clients come from across the San Fernando Valley. If a Van Nuys estate ends up in court, the case is heard by the Los Angeles Superior Court, and the firm can prepare and present it.

Why the Size of an Estate That Triggers Probate Surprises Van Nuys Families and What Our Attorneys Explain

The example begins with its simplest version. A couple has lived in their Van Nuys house since they were young. They have a savings account, two cars and the house, all in their own names. Gold Law's estate planning attorneys often hear that an estate like this is too simple for court to matter. The value of the house usually changes that answer.

In California, probate means a court supervised transfer of a person's property after death. California lets an estate below limits set by statute skip the full process by using simpler procedures. Those limits are adjusted every few years, so the current figure has to be checked rather than remembered. Once a home is counted, many estates exceed the limit the family assumed it was well below.

Can an Estate Planning Lawyer in Van Nuys Keep Your Home Out of Probate

In the next stage of the example, the couple signs a will and feels finished. A will names who inherits and who manages the estate, but it does not by itself keep property out of court. The will is the document that tells the court what to do, which means a court case is usually still needed for property left in the owner's name.

A revocable living trust holds your property under written instructions during your life and names who receives it at death. The person who creates it stays in charge and may revise it. Funding a trust means actually moving property into the trust's name. A funded trust, together with correct beneficiary designations and titling, ordinarily lets an estate pass without a full court proceeding. Even so, the outcome is never guaranteed.

What a Van Nuys Family Actually Has to Do to Fund a Trust With Their Lawyer

The third stage of the example adds a trust, and with it real work. Signing the trust document does not complete the job. The family gathers statements, the firm prepares and records a deed, account titles change, beneficiary forms are updated, and each change is confirmed. The effort matters more than the size of the estate.

Which Documents to Gather Before the First Meeting

A recent statement for each bank, brokerage and retirement account gives the firm the exact account names. A copy of the deed confirms how the house is titled today. Life insurance statements and any older will or trust round out the picture. Having those papers at the first meeting keeps the rest of the process short. If a statement is missing, the firm can help locate it.

Which Steps the Firm Handles and Which Happen at Your Bank

The trust, the will and the deed are signed before the required witnesses or notary, and the firm handles recording the deed with the county. Account retitling usually happens with each bank or brokerage. Some institutions accept paperwork by mail, while others want the account holder to visit a branch in person with identification and a certification of trust. The firm tells you what each institution needs. Beneficiary forms for retirement accounts and life insurance are updated on each company's own paperwork.

What Determines How Quickly a Trust Is Fully Funded

Drafting usually moves quickly once the family's information is gathered. Funding depends on how quickly each institution processes its paperwork and how steadily the family works through the list. Recording the deed with the county can also take some time to show up on the public record. The firm follows up on anything still open so the list does not stall. Two details decide whether the list is truly finished.

Why the Last Two Accounts Are the Ones People Forget

The first accounts to change are usually the large ones people think about every day. Small savings accounts, old certificates of deposit and forgotten brokerage accounts come last. By then, the remaining paperwork can feel optional. Left in the owner's name, those small accounts can still count toward the court limits.

How a Family Confirms Each Change Went Through

A change is complete only when the institution confirms it in writing. A new statement showing the trust as owner, or a recorded copy of the deed, is the proof. The firm asks families to send those confirmations so the file shows what has been finished. An item without confirmation stays on the list. Keeping those confirmations with the trust gives the successor trustee a clear record later.
