Estate Planning Lawyer in Northridge
When a parent needs more help, the bank, the doctor and the insurance company all ask who has the authority to act. An estate planning lawyer in Northridge can prepare the documents that answer that question while your parent is still able to sign them.
Each of those requests has a document that satisfies it, and problems arise when that document does not exist. Planning done early keeps the process calm and orderly.
Gold Law serves Northridge families throughout the San Fernando Valley from its office at 484 Mobil Avenue, Suite 26 in Camarillo. Conservatorship and estate matters for Northridge residents are heard in the Los Angeles Superior Court, where Gold Law handles the filings.

What a Family Caregiver in Northridge Needs Before a Crisis and How Our Lawyers Prepare It
When a bank or loan servicer asks whether you are authorized on an account, a family often learns that informal help is not enough. Gold Law's estate planning attorneys usually prepare four documents for a parent who wants a caregiver to be able to step in. Each one answers a different institution's question.
A durable power of attorney for finances names an agent, the person who will handle money matters. An advance health care directive names a medical decision maker and records treatment wishes. A health information authorization lets named people receive medical information. When the parent owns real property, a trust is added to hold that property under written instructions.
Consider a daughter who pays her mother's utility bill from a joint account. She still cannot discuss the mortgage with the servicer. Joint ownership of one account does not extend to the parent's other accounts, insurance policies or real property. Hospitals and insurance companies may also limit what they discuss with a relative who has no written authority. Each of these documents has to be signed while the parent still has the capacity to understand it.
Why Northridge Attorneys Recommend a Power of Attorney Long Before a Parent Loses Capacity
Most financial institutions then ask to see a power of attorney. A durable power of attorney lets the agent act on the parent's financial affairs. Durable means the authority continues if the parent later becomes unable to make decisions. Families who wait until after a hospital stay often find the parent can no longer sign it.
Consider a son who raises the subject only after his father's second fall. By then, the father's doctor has concerns about his understanding. A power of attorney is no longer an option, and the son faces a court petition instead. The same document, signed a year earlier, would have taken one appointment.
When a Financial Power of Attorney Starts and When It Stops
Probate Code section 4152 lists the events that end an agent's authority. They include the parent's death, revocation, and the agent's own death, resignation or incapacity. Once the parent dies, the power of attorney generally stops working and the will or trust takes over. Gold Law drafts each power of attorney so the start and the end are clear. A parent can also name a backup agent in case the first choice cannot serve.
How California Requires the Document to Be Signed
Probate Code section 4121 says a power of attorney must be dated and signed by the parent, or by another adult signing in the parent's presence and at the parent's direction. It must also be either notarized or signed by two qualifying witnesses. Many banks and title companies are familiar with notarized documents. When witnesses are used, the attorney explains beforehand who may serve.
Choosing Between Immediate and Springing Authority
An immediate power of attorney takes effect as soon as it is signed. A springing power of attorney takes effect only when a stated event occurs, usually incapacity. Under Probate Code section 4129, the document can name who may confirm that event in a written declaration under penalty of perjury. A springing document gives the parent more control, while an immediate one avoids a delay when help is needed.
Why Some Institutions Ask for Their Own Forms as Well
Some banks and brokerages ask the agent to complete their own paperwork as well. Probate Code section 4406 addresses this for the California statutory form power of attorney. It says a refusal is unreasonable if the only reason is that the document is not on the institution's own form. Presenting the document before it is urgently needed gives an institution time to review a new agent.
What Northridge Lawyers Put in a Health Care Directive So Hospitals Can Use It
When a patient cannot answer for themselves, hospitals ask whether a health care agent is on file. An advance health care directive names the person who speaks for the patient and records what the patient wants. Gold Law prepares it so the agent and the doctors can both rely on it.

Helping a parent is easier when the paperwork is already in place. Gold Law prepares the documents a caregiver needs and explains what each one does. The goal is a plan your parent understands and agrees with. You can call on your parent's behalf to ask how the process works.
Start by writing down who your parent wants to name for money matters and for medical decisions. Gather a list of accounts, the deed to the home and any documents your parent signed years ago. Those older papers show what can be kept and what needs updating.
